These Terms of Service ("Terms") govern the relationship between StoreKite (operated by Szymon Bubała, Poland) and any client who engages StoreKite's services. By booking a discovery call, signing a project agreement, or otherwise engaging our services, you agree to these Terms.
StoreKite is a trading name operated by Szymon Bubała, an entrepreneur registered in Poland under Polish law (NIP/tax registration details provided upon request). Registered office: Poland. Contact: [email protected].
These Terms apply to all services provided by StoreKite unless a separate written agreement explicitly supersedes specific provisions.

The exact scope, deliverables, timeline, and pricing for each engagement are defined in a separate Project Agreement signed by both parties before work begins.
Discovery Call
All projects begin with a free 30-minute discovery call to assess your needs, review your current technical setup, and determine project fit. There is no obligation to proceed.
Project Agreement
Before any billable work begins, StoreKite prepares a detailed Project Agreement specifying scope, deliverables, timeline, and price. Work commences only after the Project Agreement is countersigned by both parties and the initial payment has been received.
Communication
Primary communication takes place via email. StoreKite aims to respond to client communications within 1 business day. Project progress is shared via agreed tools or regular status updates as specified in the Project Agreement.
Revisions and Change Requests
Each project includes a defined number of revision rounds as specified in the Project Agreement. Revisions within scope are included. Change requests that expand the agreed project scope will be assessed and quoted separately at StoreKite's standard rate.
Pricing
All prices are quoted and invoiced in EUR. VAT may be applicable depending on the client's country and business registration status. Polish VAT rules apply to clients based in Poland.
Payment Structure
Payment Terms
Invoices are payable within 14 days of issuance. Late payments accrue statutory interest as provided under Polish law (Ustawa o terminach zapłaty w transakcjach handlowych). StoreKite reserves the right to suspend work on outstanding projects until overdue invoices are settled.
Cancellation
If the client cancels the project after work has commenced:
Client's Intellectual Property
Upon receipt of full payment, all custom code, configurations, designs, and content created specifically for the client's project become the client's property. StoreKite transfers all applicable intellectual property rights to the client.
StoreKite's Intellectual Property
StoreKite retains ownership of its proprietary tools, internal frameworks, templates, methodologies, and pre-existing code used in building the client's project. A non-exclusive, irrevocable license to use these components within the delivered project is granted to the client.
Portfolio and Case Study Rights
Unless explicitly requested otherwise in writing before project commencement, StoreKite retains the right to reference the project in its portfolio and to use anonymized, aggregated data (without disclosing confidential business information or trade secrets) for marketing and case study purposes.
StoreKite provides services as described and agreed in the Project Agreement. We make no warranties beyond what is explicitly stated in the Project Agreement.

After the 90-day support period, ongoing support is available through the AI Care monthly retainer or on a time-and-materials basis at StoreKite's standard hourly rate.

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from or relating to these Terms or any Project Agreement shall be resolved by the competent civil courts having jurisdiction over StoreKite's place of business in Poland.
For consumers (B2C): Nothing in these Terms limits or excludes any rights you may have under applicable consumer protection legislation.
For businesses (B2B): Disputes shall be resolved exclusively by the court competent for StoreKite's registered place of business.
StoreKite may update these Terms of Service from time to time. The date of the most recent revision is shown at the top of this page. For ongoing projects, the Terms in effect at the time of signing the Project Agreement apply for the duration of that project.
